San Diego City Council is considering allowing medical marijuana dispensaries in the city again, and will take up the topic today at their Monday council meeting.
After ordinances allowing dispensaries – albeit with very strict regulations – were nullified in 2011, the city has been without medical marijuana laws. The existing shops were deemed illegal and the city shut down the roughly 100 or so in town.

A hash oil extraction gone horribly wrong in San Diego left one man, 21, in critical condition burned over most of his body and a woman, 22, burned on her face, hands and feet. Officials haven’t released the names of the two, only that they were using cans of butane to extract hash oil in the extended-stay hotel.
Fire officials say they did about $600,000 in damage to the second floor hotel room and surrounding rooms of the Heritage Inn in San Diego across a channel from Sea World. A third person was hurt when the wall of his adjoining hotel room exploded. Officials told the U-T San Diego that this was the first hash oil explosion they had ever encountered.

The mayor’s order decrees an immediate stop to the city’s practice of filing code-enforcement violations against the collectives.

Acting on City Attorney Jan Goldsmith’s advice, the mayor sent a letter [PDF] to Kelly Broughton, director of San Diego’s Development Services Department, reports Dave Maass at San Diego CityBeat.

Advocates fight to overturn a wrongful conviction and preserve the right to a medical marijuana defense
Appellate court oral arguments are set to occur Thursday in a widely watched medical marijuana dispensary case that raises the question of what defines a legitimate dispensary. Nearly a year ago, medical marijuana patient advocacy group Americans for Safe Access (ASA) appealed the September 2010 conviction of San Diego dispensary operator Jovan Jackson.

The campaigns to allow and regulate medical marijuana dispensaries in Lemon Grove, Del Mar and Solana Beach, California (Propositions T, H and W, respectively) have recently received the endorsements of political parties in San Diego County from across the political spectrum, including the San Diego County Democratic Party, the San Diego County Libertarian Party and the San Diego County Green Party.
“These endorsements show just how mainstream, and broad, the fight for medical marijuana access has become,” said the group Citizens for Patient Rights in a press release. “Unlike other political issues, which tend to clearly divide conservatives and liberals, the rights of the citizens of the State of California to allow qualified patients access to marijuana medicine has clearly united compassionate voters on all sides of the aisle.”

The only licensed medical marijuana dispensary in San Diego County, California — Mother Earth Alternative Healing Coop, Inc. — was forced to close its doors and cease operations Tuesday a a result of the U.S. Attorney’s office pressure to force its eviction.
The El Cajon facility said it had served thousands of medical marijuana patients since it opened in July 2011, and had complied with all state and local laws, even the very restrictive policies adopted by San Diego County. It was cited as a model operation and was lauded by many as completely fulfilling the intent of California voters who approved Proposition 215, the Compassionate Use Act of 1996. 
“The loss of this facility today is a real tragedy for those patients who turned to us to help relieve the pain and suffering associated with treatments for life threatening cancers and other conditions,” said Bob Riedel of Mother Earth, Inc. “This is a sad day for them and a sad day for those who believe that the federal government has overstepped its bounds in pursuing a dubious course of action to close facilities that are legal under current state law.

A proposed ballot measure to regulate medical marijuana dispensaries in the city of San Diego which would also impose a tax on dispensary operators won’t be on the ballot in November, supporters announced on Monday.

The dispensary-sponsored groups Citizens for Patient Rights and the Patient Care Association were unsuccessful in getting 62,057 signatures by Monday’s deadline to qualify. The number of signatures collected fell badly short at under 20,000, less than a third of what was required.
“Qualifying a ballot initiative in the City of San Diego is extremely cost prohibitive,” the group said in a Monday press release. “Recently, the proponents of the successful Proposition B spent over 1.1 million to qualify their initiative for the ballot, according to the San Diego Union Tribune.”

​Activists in the last week have filed initiative proposals to allow medical marijuana dispensaries in Encinitas, Solana Beach, Lemon Grove and La Mesa, all cities in north and east San Diego County, California. Another ballot initiative is in the process of being filed in Del Mar.
Citizens for Patient Rights, in association with the Patient Care Association, announced that they are expanding their direct democracy campaign for safe access to sympathetic communities around San Diego County.

​Federal Drug Enforcement Administration agents raided three medical marijuana dispensaries in San Diego at exactly 4:20 p.m. on Thursday, acting on a “landlord law” that was put into action after a crackdown announced by the U.S. Attorney’s office last October.

Landlords who rent to dispensaries were warned to evict their tenants are face prosecution and forfeiture of their property, reports Tony Shin at NBC San Diego.
