Yesterday, on a nearly unanimous 8-1 decision, the San Diego City Council finally cast a meaningful vote on establishing an official medical marijuana business ordinance in the city, laying down a law on pot shops for the first time since the California Compassionate Use Act, commonly referred to as Prop 215, was passed nearly 18 years ago.

Just over one year ago, on October 24th, 2012, historical legal precedent was set in the state of California in regard to its ambiguous medical marijuana laws. San Diego based medical marijuana storefront owner, Jovan Jackson, had been tried in court twice, based first on entrapment style undercover buys in 2008 (acquitted of all charges), and then trumped up charges of possession and sale of marijuana after a raid on his shop in 2009, of which he was eventually found guilty.

Authorities in San Diego say that drug runners have been moving cocaine and marijuana literally under their noses for some time now.
Members of the DEA, Customs and Border Protection and ICE found the nearly three-quarter mile long tunnel earlier this week south of the Otay Mesay crossing into Tijuana, Mexico. Entrances were hidden in two warehouses, one on the U.S. side and the other in Mexico.

Estimates are that the city of San Diego has over 70,000 medical marijuana patients, yet, the city has never passed an ordinance allowing medical marijuana dispensaries, nor has it passed any official ban on the blooming industry.
This no-man’s-land of cannabis legality in America’s Finest City, compounded by the confusion and grey-area in the state medical marijuana laws, led to a rampant rise in the number of storefront weed dispensaries to nearly 300 at the peak in 2010…and then an equally rapid shuttering and/or raiding campaign that saw all but a stubborn few shops close their doors in 2011.

Almost exactly two years ago, on August 5th, 2011, the Coronado Police Department received an anonymous tip that Michael Lewis and his wife Lauren Taylor were operating an illegal covert daycare operation, and worse, that they were smoking weed around the children.
Acting on that tip, officers visited Lewis’ home on upscale Coronado Island, and were allowed entrance to the residence by Lewis and his wife. Satisfied that there was no secret babysitting cartel headquartered in the home, officers did discover Lewis’ personal stash of pot, for which he promptly provided a valid California doctor’s recommendation. What should have been the end of the story was just the beginning of a two-year-long nightmare for Lewis, his wife, and their two kids.

San Diego Mayor Bob Filner is a friend of medical marijuana patients. Not only has the guy apologized for federal raids on dispensaries in his city, he’s now urging jurors in a local medical marijuana case to ignore federal marijuana laws and find a defendant not guilty for operating a medical marijuana dispensary.
Ronnie Chang was arrested by federal agents in 2009 and faces trial this fall. His attorneys argue that he was following California law allowing him to operate a medical marijuana center. But federal courts won’t allow those arguments to be heard since they don’t recognize medical marijuana at all.

Here’s an awful situation no matter which way you view it. One-year-old Harley Bradford and her two-year-old brother, Jason, are dead after their mother found them both face down in a San Diego area swimming pool just before 10 a.m. on Monday morning. The children’s mother has yet to be charged with a crime.
The mother, identified as Tessie Behrens by CBS8 San Deigo, claims that she could not find her kids when she awoke at the home of a family friend around 9:30 a.m. Searching frantically, she found them both unconscious in the pool.

San Diego Mayor Bob Filner apologizes for raid on local marijuana dispensary

On Monday afternoon at a City Council meeting, San Diego resident Ken Cole spoke out as a business owner and a citizen in favor of Mayor Filner’s proposed new medical marijuana dispensary ordinance. Both he and the Mayor’s office watched in dismay as the City Council voted to essentially ignore them.
Tuesday morning, Cole’s downtown San Diego cannabis collective, One on One, was raided by federal DEA agents and local authorities with the Sheriff’s office who literally broke down the front door and carried out cash, crops, and computers past a crowd of angry protesters.

In 1996, California voters legalized medical marijuana for qualified patients and caregivers. Nearly two decades have passed, and the city of San Diego has yet to enact an ordinance which would regulate medical marijuana dispensaries, and provide the guidelines by which they could legally open.

In nearly four hours of testimonies given by dozens of San Diego citizens on Monday, the eight sitting City Council members heard arguments given both in favor of, and against, Mayor Bob Filner’s new proposed ordinance to allow for the legal and regulated re-opening of medical marijuana dispensaries in America’s Finest City.

That was the case with a 33-year-old Mexican woman who works days in San Diego. She crossed the border around 3 a.m. Friday on her way to work. She got there earlier than expected, so she decided to chill out in her car and likely take a little cat nap before her shift.
